Terms of service governing use of specimenexpress.com and home improvement services offered by Specimen Express.

These Terms of Service ("Terms") govern your access to the website at specimenexpress.com (the "Site") and any home improvement services, consultations, or quotes provided by Specimen Express ("we," "us," or "our"). By using the Site, submitting a form, or engaging our painting, flooring, tiling, or related renovation services, you agree to these Terms. If you do not agree, do not use the Site or our services.
1. About Specimen Express
Specimen Express provides residential home improvement services including interior painting, floor installation and refinishing, tile work, drywall repair, trim and millwork, and targeted kitchen and bathroom updates. Information on the Site describes typical offerings but does not guarantee availability in every region or for every property type. Final scope, pricing, and schedule are defined only in a written proposal or contract signed by both parties.
We may update service lines, material suppliers, or crew capacity over time. The Site reflects general capabilities at the time of publication and may not list every specialty or limitation.
2. Website use
You may browse the Site for personal, non-commercial purposes related to evaluating home improvement options. You agree not to misuse the Site by attempting unauthorized access, introducing malware, scraping content for republication, or interfering with Site operation. Content—including text, images, logos, and layout—is owned by Specimen Express or licensed for our use and may not be copied, modified, or distributed without written permission except as allowed by applicable law.
Links to third-party social sharing tools are provided for convenience. Those platforms have their own terms and privacy policies; we are not responsible for their practices once you leave the Site.
2.1 Accuracy of information
We strive to keep service descriptions, pricing examples, and project photos accurate. However, construction conditions vary by home. Published price points are starting references; your quote may differ based on room size, substrate condition, material selection, access, and occupancy requirements. Do not rely on the Site as the sole basis for budgeting without obtaining a written estimate.
3. Quotes, contracts, and scope
Contact forms, email exchanges, and phone discussions are preliminary unless confirmed in a signed scope document. A binding agreement forms when you accept a written quote or contract that specifies labour tasks, material allowances, timeline, payment schedule, and warranty terms for workmanship.
Hidden conditions—such as rot behind drywall, inadequate subfloor structure, or outdated wiring discovered during demolition—may require change orders. We document findings with photos and written description before proceeding with additional work or costs. You may decline extra scope; however, skipping recommended repairs may affect durability or void certain manufacturer warranties.
3.1 Client responsibilities
You agree to provide safe access to work areas, secure pets and valuables, and disclose known hazards such as asbestos-containing materials or lead-based paint where applicable. If you supply materials, they must meet specifications we confirm in writing. We are not liable for failures caused by incompatible customer-supplied products.
Utility shutoffs, parking arrangements, and building or strata approvals are your responsibility unless explicitly included in our scope. Delays caused by unavailable permits or denied access may adjust schedule and, where applicable, incur standby fees stated in your contract.
4. Scheduling and site conditions
Start and completion dates are estimates based on normal drying times, supplier lead times, and crew availability. Weather, material backorders, or unforeseen structural issues may extend timelines. We communicate revisions promptly and prioritize safety and quality over arbitrary deadlines.
Work in occupied homes requires cooperation on dust control, pathway access, and temporary loss of room use. You acknowledge that paint odours, noise, and limited access to kitchens or bathrooms may occur during active phases. We use ventilation and low-VOC products when specified but cannot eliminate all disruption.
5. Payment terms
Payment schedules appear on your signed proposal—commonly a deposit to reserve dates, progress payments at defined milestones, and final balance at walkthrough approval. Unless otherwise stated, deposits are non-refundable once materials are ordered or schedules are locked. Late payments may pause work and accrue fees specified in your contract.
Published Site prices use a dollar sign for clarity, such as $48, $96, or $160 per unit shown on the pricing page. Contract totals include applicable taxes where required by law. Disputes over invoiced amounts must be raised within fourteen days of receipt with supporting detail.
6. Warranties and limitations
We warrant workmanship according to terms in your project agreement—typically covering defects in application for a defined period when maintenance guidelines are followed. Manufacturer warranties apply to products we supply; registration and care instructions are provided at handover.
Warranty does not cover damage from subsequent trades, improper cleaning agents, structural movement, moisture intrusion from unrelated leaks, or normal wear in high-traffic areas. Colour variation between touch-up and original coats may occur over time due to fading; we document batch numbers when feasible.
6.1 Disclaimer of implied warranties
Except as expressly stated in your signed contract, services and Site content are provided "as is" without implied warranties of merchantability or fitness for a particular purpose. We do not guarantee that the Site will be uninterrupted or error-free.
7. Liability cap
To the fullest extent permitted by law, our total liability for any claim arising from services or Site use is limited to the amount you paid us for the specific project giving rise to the claim. We are not liable for indirect, consequential, or punitive damages including lost rent, alternative housing costs, or emotional distress except where such limitation is prohibited.
You maintain homeowner's or property insurance appropriate to renovation risk. We carry trade insurance as required for our operations; certificates are available on request for active projects.
8. Photography and testimonials
With your written consent, we may photograph completed work for portfolios, the Site, or marketing. We do not identify your full address without permission. If you provide a testimonial, you grant us a non-exclusive license to display it with attribution you approve.
You may revoke photo or quote usage for future publications by written notice; already printed or cached materials may persist for a reasonable period beyond our control.
9. Email and newsletters
Subscribe and unsubscribe functions on the Site manage promotional email preferences. Transactional messages about active quotes or projects may continue until those matters close. Newsletter content is informational—not a substitute for on-site assessment of your home's conditions.
10. Intellectual property
The Specimen Express name, logo emblem, and original Site content are protected. Trademarks of material manufacturers mentioned on the Site belong to their respective owners. You may not imply endorsement or partnership without authorization.
11. Termination
Either party may terminate a project according to cancellation terms in the signed contract. You remain responsible for work performed, materials ordered, and reasonable demobilization costs through the termination date. We may refuse or discontinue service for unsafe conditions, abusive conduct toward crew, or repeated access failures.
12. Dispute resolution
We prefer resolving concerns through direct discussion with your site lead and management. If informal resolution fails, disputes shall be handled under the governing law specified in your project contract or, if silent, the jurisdiction where Specimen Express primarily operates. Mediation may be required before litigation where contractually agreed.
13. Changes to these Terms
We may revise these Terms by posting an updated version on the Site with a new effective date. Material changes affecting active contracts will be communicated separately when feasible. Continued Site use after updates constitutes acceptance of revised Terms for browsing; signed project terms prevail for ongoing work.
